kidSAFE Website Privacy Policy

1. Introduction
This Privacy Policy (“Policy”) describes how Samet Privacy, LLC, owner and operator of the kidSAFE® Seal Program (“kidSAFE,” “we,” “us,” or “our”), collects, uses, stores, and shares information gathered through www.kidsafe.com (the “kidSAFE Site” or “Site”). 1. Scope of This Policy
This Privacy Policy applies to:
- Representatives of companies and organizations (“Business Contacts”) that sign up for, or contact us, regarding kidSAFE membership, certification, partnership, events, or other related business matters;
- Business Contacts who sign up or opt-in to receive email communications from us;
- Other individuals (such as parents and educators) who visit the Site, browse our member list, or report a concern regarding a kidSAFE member product;
- Data that we may collect from the people listed above, including personal information (such as name, email address, phone number, other contact information), financial information (such as billing and payment information), demographic information (such as age and non-precise geographic location), and anonymous usage data (such as website analytics).
This policy does not cover:
- Information collected through kidSAFE's auditing or testing of member products, which is governed separately by our membership terms and/or contractual agreements with kidSAFE Members;
- The privacy practices of any website, app, or other online product that is a member in the kidSAFE Seal Program. You should review the privacy policy of each such product before using their services.
3. Who This Site is Intended For
The Site is primarily intended for businesses and professionals. It is also intended as a resource for adults, including parents and educators, to discover age-appropriate online experiences for their children and students. This kidSAFE Site is not directed at or intended for children or minors, and we do not knowingly collect personal information from such visitors. If we learn that we have inadvertently collected information from a child or minor, we will delete it promptly. 4. Information We May Collect and How We Collect It
We may collect information automatically from your device and browser when you visit the Site and directly from you through forms on the Site.
4a. Website Analytics Data Collected Automatically
When you visit the Site, we may automatically collect certain technical and usage information, including your device identifier (IP address, device ID, etc.) non-precise geographic location, browser type and version, operating system, pages visited, time spent on each page, and the source from which you arrived. This information is analyzed through our website analytics service to understand how the Site is used. We take steps to anonymize (or have our service provider anonymize) the website analytics data we collect by enabling IP masking and disassociating the data from logged-in user accounts. See Sections 6 and 7 for further details.
4b. Business Contact Data Collected Via Inquiry and Seal Application Forms
The Site may include forms through which businesses can contact us with questions or inquiries about our Seal Program and services, as well as apply for one or more of the kidSAFE Seals. We collect the information you voluntarily provide on these forms, which may include your name, company name, company location, job title, email address, phone number, and details about your inquiry or the products you wish to consider for kidSAFE membership. We use this information to respond to your request, and, if applicable, to set up and manage an account for your company or products in our back-end system. This information may further be used to manage our ongoing business relationship with you, including sending you important administrative communications about your membership in our Program and your use of the kidSAFE Seal(s).
4c. Name and Email Information for Newsletter Sign-Ups
If you sign up to receive communications from kidSAFE (either through a newsletter sign-up form or checkbox on another form), we collect your email address and any additional information you provide at sign-up, such as your name or company name. We use this information to send you our business newsletter, which provides periodic alerts about important regulatory developments, membership news, and industry events. You can opt out at any time by using the unsubscribe link in the footer of any newsletter communication we send to you.
4d. Registration and Financial Data for kidSAFE Webinars and Events
We may host or run periodic educational webinars or industry events (including kidTECH) for our members or industry stakeholders. In doing so, we may collect the names and business contact data of those who register for such events, as well as billing and payment information when such events require a purchase. We may use a third party videoconferencing and/or ticketing platform to help operate these events. For webinars or conferences that are co-hosted or sponsored by other companies (including possibly kidSAFE members), your business contact information may be shared with such companies if you register for the event.
4e. Consumer Data via “Report Concern” Forms
Our Site includes a “Report Concern” form that allows parents, educators, and other interested adults to report to kidSAFE an online safety, content, or privacy-related concern or issue about a product on our member list. When you submit a report, we request or collect the following information:
- The name of the member product or service being reported;
- Your age, for age screening purposes;
- The email address of a parent or other grown-up, for follow-up communication;
- Type of issue being reported and a description of your concern or complaint;
- Any supporting files or documentation you choose to upload.
The information a consumer shares with us when reporting a concern about a member product may be forwarded to the appropriate member company so they can investigate the matter further and resolve it directly with the consumer.
5. How We Use Your Information
We use the information we collect to respond to inquiries and applications; administer and improve the kidSAFE Seal Program; send communications to members and newsletters subscribers; manage our relationships with current and prospective members; run events such as conferences and webinars, understand how the Site is used and improve its content and functionality; comply with our legal obligations, including our obligations as an FTC-Approved COPPA Safe Harbor Program; and protect the rights, safety, and intellectual property of kidSAFE, our Site users and visitors, and the public.
We do not use, share, or sell your personal information for behavioral advertising purposes, to build user profiles for commercial purposes, or to train artificial intelligence models.
6. Third-Party Service Providers and Tools
We use third-party service providers and tools to help us operate certain features on the Site, administer our Seal Program, and support our back-end operations. Each provider processes data, including (in some cases) personal information, on our behalf and subject to our instructions or custom configurations. We do not authorize any provider to use your personal information for their own independent marketing purposes. Here are examples of the categories of service providers that we use:
- Website Analytics. We use a third-party analytics service to understand how visitors use the Site, collecting information such as page visits, session duration, and traffic sources. This information is used for site improvement purposes only. See Section 7 for opt-out options.
- Cookie Consent Management. We use a third-party consent management platform to manage cookie preferences on the Site, scan and categorize cookies, and record user consent choices in compliance with applicable privacy laws.
- Customer Relationship Management (CRM). We use third-party CRM and contacts platforms to manage business contact records and leads for companies who inquire about or apply for kidSAFE membership through the forms on this Site. These platforms are also used to help us track the progress of onboarding new members and their resolution of any valid consumer-reported issues.
- Email marketing and social media management. We use a third-party platform to distribute our newsletter communications to subscribers, and to publish content to our social media channels, including LinkedIn and Twitter/X.
- Embedded Media and Content Delivery. Our Site embeds video content from a third-party video platform, configured to disable cross-site tracking. When you view embedded video, the platform processes data necessary to deliver the content, including your IP address. We may also use third-party services for scripts and other technical website functionality.
- Webinar Hosting and Event Ticketing. We use third party videoconferencing and ticketing platforms to help us run periodic webinars and events. The data collected through these platforms may also be subject to the privacy policies for those respective platforms.
- Cloud and Hosting Providers. We use third party cloud storage services and hosting providers to securely store the information we collect through the forms on the Site. Data is stored on servers located in the United States.
7. Cookies and Tracking Technologies
Our Site uses cookies and similar tracking technologies. We use a third-party consent management platform to manage your cookie preferences. The cookies on our Site fall into two categories: necessary cookies, which are required for basic Site functionality; and analytics cookies, which help us understand how visitors use the Site. You can update your cookie preferences at any time through the consent banner or your browser settings. Blocking certain cookies may affect Site functionality.
We also recognize and honor Global Privacy Control (GPC) signals. Because we do not sell or share personal information for cross-context behavioral advertising, the GPC signal has no practical effect on our data practices, but we acknowledge your preference and confirm our practices are consistent with it.
8. Information Sharing
Beyond what is already mentioned earlier in this Privacy Policy, we may share information, including your personal information, in the following additional circumstances: with law enforcement or regulators when required by law or valid legal process, including FTC reporting obligations under our COPPA Safe Harbor program; to protect the rights, property, or safety of kidSAFE, our users, or the public; and in connection with a merger, acquisition, or sale of assets, in which case we will notify you of any material changes to how your information is handled, and if required by law, obtain your prior consent.
9. Data Security
We maintain reasonable administrative, technical, and procedural safeguards to protect the information we hold from unauthorized access, loss, misuse, or alteration, including encrypted communications and access controls. No security system is completely impenetrable. If we become aware of a breach that may have affected your personal information, we will notify you as required by applicable law.
10. Data Retention
We retain information for as long as necessary to fulfill the purposes described in this policy, subject to applicable legal and regulatory requirements. We may retain information for longer periods where required by law, to resolve disputes, or to enforce our agreements.
11. Your Privacy Rights and Choices
Rights Available to All Users
Regardless of where you are located, you may request access to, correction of, or deletion of your personal information; opt out of marketing emails at any time via the unsubscribe link in our emails; and opt out of certain cookies through our cookie consent tool.

California Residents (CCPA/CPRA)
California residents have additional rights under the CCPA as amended by the CPRA, including the right to know what personal information we collect, use, and disclose, including information collected since January 1, 2022; the right to delete and correct personal information; the right to opt out of the sale or sharing of personal information (we do not sell or share personal information for cross-context behavioral advertising); and the right to non-discrimination for exercising these rights. EEA, UK, and Switzerland Residents (GDPR and Equivalent Laws)
Residents of the EEA, UK, and Switzerland have additional rights under the GDPR or applicable equivalent laws, including rights of access, rectification, erasure, restriction, portability, and objection, as well as the right to withdraw consent where processing is based on consent. Our lawful bases for processing are: legitimate interests (analytics, business contact management, program administration, and complaint record retention); and consent (newsletter subscriptions). Other U.S. State Privacy Rights
Residents of states with applicable privacy laws, including Virginia, Colorado, Connecticut, Texas, Oregon, Montana, and others, may have rights similar to those described above. We will honor valid requests to the extent required by applicable law. Contact us here to submit a request.
12. International Data Transfers
kidSAFE is based in the United States and our servers and service providers operate primarily in the United States. If you are accessing the Site from outside the United States, your information may be transferred to and processed in the U.S., where data protection laws may differ from those in your country.
For transfers from the EEA, UK, or Switzerland, we ensure that appropriate safeguards are in place as required by applicable law, primarily through the data transfer terms incorporated into our agreements with our service providers.
13. Changes to This Policy
We may update this Privacy Policy from time to time. The “Last Updated” date at the top of this page reflects the most recent revision. If we make material changes, we will post a notice on the Site, and for changes that retroactively affect how we use personal information already collected, we will take additional steps to notify affected individuals (such as emailing business contacts), and if required by law, obtain prior consent.
